Abstract

Environmental fines are an economic penalty for environmental crimes, aimed at deterring criminal behavior and compensating for environmental damage. The restorative alternative punishment system, as a new approach to replacing traditional penalties, follows the concept of restorative justice and holds offenders accountable for restoring the environment. While fines are widely applied in environmental crime penalties in China, their implementation faces various challenges. The restorative alternative punishment system provides a new perspective, with the incorporation of restorative measures enhancing the effectiveness of enforcement. However, there is currently a lack of clear legal regulations for this system in China. This paper explores the concept, current situation, and improvement pathways of the environmental fine restorative alternative punishment system, drawing on international experience. It suggests improving relevant legal regulations, clarifying the scope of application, and establishing supervision and evaluation mechanisms. These measures aim to ensure the scientific and effective implementation of restorative justice, thereby achieving better environmental protection and ecological restoration outcomes.
