Abstract

This study aims to analyze Decision Number 226/Pdt.Sus-PKPU/2023/PN.Niaga.Jkt. Pst. in the context of settling debt suspension (PKPU) disputes from a business and bankruptcy law perspective. This study highlights the legal considerations used by judges, the relevance of the decision to the protection of creditors and debtors, and its implications for the principles of efficiency and fairness in resolving PKPU disputes. Using a juridical-normative method and a case study approach, this study finds that this decision reflects the dynamics of the application of business and bankruptcy law in Indonesia. The results are expected to provide theoretical and practical contributions to the development of business and bankruptcy law, particularly in the context of PKPU.
