Abstract

The focus of this research is on the justice system model for disputes over village head election results. There are two problem formulations raised in this research, namely how to regulate disputes over village head election results in positive law and what is the model of the justice system for resolving disputes over village head election results from the perspective of ius constituandem. The research method uses a normative approach, sources of legal materials include primary legal materials and secondary legal materials, techniques for collecting legal materials using libraries and internet studies, then analyzed qualitatively descriptively. The theories used as material for analysis include the theory of democracy, the electoral system and the judicial system. Based on the results and discussion of the arrangements for resolving disputes over election results in villages which have so far not been clear and firm and the arrangements have been left to the districts/cities according to local wisdom, giving rise to legal uncertainty. For this reason, in the future, the model of the judicial system for resolving election results disputes to villages needs to be established in the future, it is necessary to establish an ad hoc court to settle election results to villages, considering that this activity only takes place 8 (eight) times, this is in the context of efficiency. For this reason, it is necessary to revise the arrangements for settling election results to regions firmly and in detail by a judicial institution, not an executive institution, and not let the executive institution have a dual function.
