Abstract

The change of sex after marriage will cause the instability of the marriage relationship, how to define the marriage validity state after the change of sex is a theoretical problem. Existing studies mainly focus on marriage and family law. Still, it is an innovative research idea to unify the measurement of civil law norms and compare the change of marriage validity caused by gender change with the change of property rights caused by non-legal acts, leading to the conclusion that marriage continues to be valid after gender change. At the same time, after all, post-marriage sex change is different from social ethics and public order and good customs, it can be properly restricted while respecting basic rights: relaxing the conditions of sex change operation and strictly controlling the registration of gender change.
