Abstract

Constitutional Court Decision No. 45/PUU-IX/2011 provides an important legal basis for the designation of forest areas to be conducted through a legitimate and participatory process to ensure legal certainty for land certificate holders. This study uses a normative juridical method to analyze the alignment of Malang Regency Regional Regulation No. 1 of 2024 on spatial planning with the decision in resolving land ownership conflicts within forest areas. The results show that the regulation does not explicitly accommodate the forest area confirmation principles mandated by the Constitutional Court. This misalignment potentially causes legal uncertainty and hampers conflict resolution. Overlapping authority between the Ministry of Environment and Forestry and local government, along with poor coordination, further hinder implementation. The study recommends harmonizing forestry and land policies and enhancing socialization to protect community rights. Aligning spatial regulations with the Court’s decision is key to sustainable agrarian conflict resolution in Malang Regency.
