Abstract

Destruction of habitat or environment is a concept called ecocide. The crime of ecocide began with environmental damage caused by environmental modification techniques used in the Vietnam War. Today, ecocide are often the result of industrial accidents or harmful corporate activities, policy misdirection, and failure to address environmental justice, or ecological disasters. The impact of ecocide is closely linked to global poverty and suffering due to socioeconomic disparities. The purpose of this study was to determine whether ecocide can be classified as environmental and to find out whether ecocide have been regulated in Law Number 32 of 2009 concerning Environmental Protection and Management (UUPPLH). The method of study used is normative legal analysis using a statutory approach and a conceptual approach. Ecocide can be classified as environmental crimes by referring to severe, widespread or long-term environmental damage. Law Number 32 of 2009 concerning Environmental Protection and Management does not yet recognize ecocide as an environmental crime. In the UUPPLH, the determination of an environmental crime is based on the level of pollution and destruction of the environment. For this reason, ecocide have the opportunity to be classified as environmental crimes by being included in national law.
