Abstract

This study aims to determine the legal policy related to new and renewable energy (EBT) to support sustainable development and create green investment, especially in the tourism sector. The current phenomenon shows that tourism activities are activities that produce significant greenhouse gases, resulting in environmental damage. In addition, the tourism industry also depends on natural resources as its main commodity, so it is necessary to preserve it. The state policy in terms of transitioning to other non-fossil-based (renewable) energy (Energy Transition) will greatly support the tourism program carried out by the region because the air around the tourist environment is clean and healthy. One way to deal with challenges in the tourism industry is to carry out green investments to overcome the negative impacts of environmental damage. This study is a normative legal study using a conceptual approach and a statutory regulatory approach, data analysis is carried out with a literature study that is analyzed qualitatively. The results of this study indicate that the regulations issued by the government related to EBT have not comprehensively accommodated the utilization of EBT, so higher regulations are needed as a legal umbrella that can provide legal certainty. This is due to the legal and economic constraints faced by the government in implementing the policy.
