Abstract

Easement system is an ancient system of other real rights originating from Roman law. As far as modern society is concerned, the easement system has made great progress, breaking through the limitations of traditional easement system in subject, content and setting conditions. This article intends to analyze the breakthrough of the modern easement system to the traditional easement by using the analysis method of law and economics, and then further think about the legislation of the easement system in our country.
