Abstract

In recent years, there are more and more cases about the punishment of network " crossing-the-wall " tools in the sales. However, in the judicial practice, there are divergences on which crime should be applied in this act. Some believe that it conforms to the crime of illegal business operation, and some believe that it conforms to the characteristics of the crime of providing intrusion and illegal control of computer information system procedures and tools. In this regard, we start from three cases, according to the severity of illegal acts, classification, comparative analysis. This paper analyses the constitutive elements and social harmfulness of the crime of illegal business operation, and investigates the essence of legal interests based on the infringement of the legal interests protected by criminal law by objective acts, so as to determine what kind of charges should be applied to the act of network "crossing-the-wall" in illegal sales.
