Abstract

Law enforcement against perpetrators of trafficking in persons mostly still uses the legal basis of Article 296 and Article 506 of the Criminal Code regarding pimping, without considering the laws and regulations of a specific nature as regulated in Law Number 21 of 2007 concerning Eradication of the Crime of Trafficking in Persons. Considering Trafficking in Persons is a form of violation of Human Rights, Trafficking in Persons is an act of recruiting, transporting, harbouring, sending, transferring or receiving a person by means of threats of violence, use of force, kidnapping, confinement, fraud, fraud, abuse of power or a position of vulnerability, debt bondage or giving payments or benefits, so as to obtain the consent of the person who has control over the other person, whether carried out within a country or between countries, for the purpose of exploitation or causing people to be exploited. The rights of victims of trafficking in persons include compensation, restitution, physical and psychological rehabilitation as a result of trafficking and the right to be integrated or returned to the family, community, and educational institutions for those who are still in school. Although there are policies that are spread in several laws and regulations that regulate the rights of victims to obtain restitution or compensation, rehabilitation, but in the criminal justice process it is still not widely implemented.
