- Abstract
This research examines the formulation of Islamic legal reform in Indonesia, particularly Article 185 of the Compilation of Islamic Law (KHI), which introduces the concept of substitute heirs. This provision marks a shift from conventional fiqh but causes legal ambiguity due to its broad interpretation of lineage, conflicting with traditional Islamic inheritance principles. The study employs a normative legal approach, using library research, document analysis, and interviews to gather qualitative data. Findings show that the substitute heir provision in Article 185 remains unclear and open to multiple interpretations, leading to inconsistent rulings in Religious Courts. To resolve this, the study proposes amending the language of paragraph (1) to replace "may" with "shall directly," ensuring automatic recognition of substitute heirs and greater legal certainty in inheritance cases.
